1. Agreement to Terms

Welcome to the website of Leonie Smith ("the Site"). These Terms of Use constitute a legally binding agreement between you ("the User") and Leonie Smith regarding your access to and use of this website, blog content, and any lifestyle coaching services offered through it. By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be unconditionally bound by these terms.

If you do not agree with any provision of these Terms of Use, you must immediately discontinue use of the Site and refrain from submitting any personal information or requests. Your continued use of the Site following the posting of revised terms constitutes your acceptance of those changes.

2. Description of Services

Leonie Smith operates a personal blog and lifestyle coaching platform focused on movement, nutrition habits, and holistic wellbeing. The services provided through this Site include, but are not limited to:

• Free blog articles, guides, and resources on active living and mindful nutrition.
• One-on-one discovery chats and lifestyle coaching sessions.
• Structured monthly and multi-month coaching programs.
• Email newsletters and periodic content updates.
• Digital templates, meal frameworks, and exercise suggestions.

All services are designed for general lifestyle and fitness education. They are not a substitute for professional advice in fields such as medicine, physical therapy, dietetics, or psychology.

3. Important Lifestyle Disclaimer

Leonie Smith is a lifestyle blogger and movement coach, not a licensed medical professional, registered dietitian, or certified physical therapist. The coaching services offered are complementary wellness and lifestyle guidance programs. Any recommendations regarding movement, nutrition, or daily habits should be interpreted as general suggestions rather than personalized prescriptions.

4. User Eligibility and Account Responsibilities

By using the Site, you represent and warrant that:

• You are at least 16 years of age, or have reached the age of majority in your jurisdiction.
• You possess the legal capacity to enter into binding agreements.
• You are not barred from using online services under the laws of your country of residence.

6. Intellectual Property Rights

All content published on the Site — including but not limited to text, articles, images, graphics, logos, icons, audio clips, video clips, downloadable files, data compilations, and software — is the exclusive property of Leonie Smith or licensed content providers, and is protected by Dutch and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the content for your personal, non-commercial use only. You may not:

• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or its content for commercial purposes without express written permission.
• Modify, adapt, translate, reverse-engineer, or create derivative works based on the Site or its content.

7. Pricing, Payments, and Refund Policy

All prices for coaching services and digital products are displayed in Euros (EUR) and include applicable Value Added Tax (VAT) unless explicitly stated otherwise. Prices are subject to change at any time without prior notice, but changes will not affect bookings or purchases already confirmed.

7.1 Accepted Payment Methods

We accept payments via bank transfer, major credit and debit cards (Visa, Mastercard, American Express), and other methods as specified at the point of purchase. Payment is due in full at the time of booking unless a written installment agreement has been established.

7.2 Cancellation Policy

You may cancel or reschedule a booked discovery chat or coaching session at no charge provided you notify us at least 24 hours before the scheduled start time. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee equivalent to 50% of the session price.

7.3 Refund Policy

• Discovery Chats: Non-refundable once the session has commenced. If cancelled with adequate notice (24+ hours), a full refund or reschedule will be offered.
• Monthly Wellness Plans: Full refund available within 7 days of purchase, minus a €25 administrative processing fee. No refunds after the program has commenced, though unused sessions may be transferable under exceptional circumstances.
• Complete Wellness Journey (90-day): Refunds available on a pro-rata basis for unused full weeks, minus a €50 administrative fee, provided the request is made within 14 days of purchase. After 14 days, refunds are at our sole discretion.

All approved refunds will be processed within 14 business days using the original payment method.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Leonie Smith shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:

• Your access to, use of, or inability to access or use the Site or services.
• Any conduct or content of any third party on the Site.
• Any content obtained from the Site or through the services.
• Unauthorized access, use, or alteration of your transmissions or content.
• Any physical discomfort, injury, or adverse outcome resulting from following recommendations provided through the Site or coaching services.

In no event shall our total aggregate liability to you for all claims exceed the greater of (a) the total amount you have paid to us for services in the twelve (12) months preceding the claim, or (b) €500.

9. Indemnification

You agree to defend, indemnify, and hold harmless Leonie Smith, her employees, contractors, agents, officers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Site and services.
• Your violation of any provision of these Terms of Use.
• Your violation of any third-party right, including intellectual property or privacy rights.
• Your violation of any applicable law, regulation, or ordinance.
• Any claim that your use of the Site caused damage to a third party.

10. Third-Party Links and External Resources

The Site may contain hyperlinks to third-party websites, tools, or resources that are not owned, operated, or controlled by Leonie Smith. We provide these links solely for your convenience and informational purposes. We do not endorse, sponsor, or assume responsibility for the content, privacy practices, terms of use, or security of any third-party websites.

Your interactions with third-party websites are governed by their respective terms and policies. We strongly encourage you to review those documents before submitting any personal information or engaging in transactions on external platforms.

11. Termination of Access

We reserve the right to suspend or terminate your access to the Site, in whole or in part, at any time and for any reason, including but not limited to breach of these Terms of Use, fraudulent activity, or conduct that we deem harmful to the Site, other users, or our reputation. Termination may occur without prior notice.

Upon termination, all provisions of these Terms that by their nature should survive termination shall remain in full effect, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the competent courts of Amsterdam, Netherlands.

Before initiating any formal legal proceedings, we encourage you to contact us directly to seek an amicable resolution. We are committed to addressing concerns promptly and fairly.

13. Severability

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, eliminated. The remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms of Use, together with our Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and Leonie Smith concerning the subject matter hereof. They supersede all prior or contemporaneous agreements, communications, proposals, and understandings, whether oral or written.

15. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Leonie Smith.
